A $26 million settlement has been agreed by McDonald’s of a class-action lawsuit which has running for long over working conditions and wages at the locations which have been run by corporate in California said the parties on Monday.
This agreement which has the settlement that covers as many as 38,000 individuals requires the Superior Court approval.
The lawsuit had been filed close to seven years ago against McDonald’s had made a lot of claims which included the failure of paying overtime and minimum wages and also to provide the required rest breaks and meals.
An aspect involved in the overnight shifts which began on a particular day and ended on the next one but had every hour attributed to the day on which the shift had begun had avoided overtime payment.
There was initially just one plaintiff however eventually there were three more that had joined for the representation of cashiers and cooks.
McDonald’s had said in their statement that it is taking responsibility being an employer that is serious and committed towards the treatment of employees.
The company has said that they do believe in their company’s policies and them being compliant with the Labor Code, they have taken a decision to resolve this particular issue which had been filed early in the year 2013. Through this settlement all the parties have reached a solution which is acceptable mutually and have submitted this to the court for reviewing and approving.
The terms of this agreement have in them the compensation for the wages and the overnight and overtime payment which was not paid along with a compensation for rest and meal breaks which had been missed.
